Industrial design represents an important component of intellectual property, as it contributes to giving products distinctive aesthetic and functional characteristics and enhancing their competitiveness in the market. Legal protection of industrial designs is particularly important in preventing imitation, unauthorized copying, and unlawful exploitation, while safeguarding the rights of designers and businesses and encouraging innovation and creativity. In Iraq, the protection of industrial designs is connected to the legal framework governing industrial property, which seeks to regulate the rights of design owners and establish requirements for their registration and protection against infringement. Registration is an important means of establishing legal rights and enabling the design owner to take appropriate legal measures when infringement occurs. Effective protection also requires a balance between the interests of designers and rights holders on one hand, and the public interest and freedom of competition on the other. With the rapid development of digital design technologies and the widespread availability of copying and reproduction tools, there is an increasing need to strengthen legal awareness among designers, educational institutions, and businesses, as well as to develop mechanisms for protecting designs against modern forms of infringement. Accordingly, improving the legal and procedural framework for industrial design protection in Iraq can contribute to creating a more supportive environment for innovation, safeguarding creative works, and encouraging investment in design and creative industries.
